Terms of Service

These terms are maintained by the InSynk team and form a binding agreement between you and InSynk. Last updated 26 July 2026. Governing law: the Republic of South Africa.

1. Agreement and acceptance

By creating an account, signing the honesty oath or using any part of InSynk (the “Service”), you agree to these Terms, our Privacy Policy and our Refund & Cancellation Policy, which are incorporated by reference. If you do not agree, do not use the Service.

You must be at least 18 years old, or 13 and older with verifiable consent from a parent or legal guardian who accepts these Terms on your behalf and is responsible for all charges.

2. What InSynk is — and what it is not

InSynk is a self-directed accountability tool. You set your own goals, a partner you choose approves or rejects each daily log, and at month end unkept promises are converted into a voluntary rand contribution that is paid out to the South African charity you selected, less an administration fee.

InSynk is not a medical, psychological, financial, legal, insurance, gambling, wagering or investment service. Penalties are not bets, stakes or prizes: no user can ever win money, and no amount is paid to another user. Nothing in the Service is professional advice. If you are dealing with a health, mental-health, addiction or financial difficulty, consult a qualified professional.

3. Your account

You must provide accurate registration details and keep your credentials confidential. You are responsible for everything done through your account. Biometric unlock is a device-level convenience lock over an existing session and is not a separate credential. Notify us immediately at the support address in the app if you suspect unauthorised access.

One person, one account. You may not share, sell or transfer your account.

4. Partner pairing and what your partner can see

Pairing uses a six-character sync code. Once paired, your accountability partner can see your goals, schedules and daily logs, and can approve or reject those logs. Partners are view-only in every other respect: they cannot create, edit or delete your goals, change your plan, or alter your billing.

Sharing your sync code is a deliberate disclosure of personal information to that person. Only share it with someone you trust. You may unpair at any time from your profile.

5. Honesty, approvals and disputes

The Service runs on an honesty system. A goal only counts once your partner approves the log for that day. InSynk does not verify whether a goal was actually completed, does not arbitrate disagreements between you and your partner, and is not liable for a partner who approves dishonestly, refuses to approve, or stops responding.

If your partner becomes unresponsive, unpair and pair with someone else. Scores are calculated from the approvals recorded at month end; unapproved logs count as unmet.

6. Subscriptions, trials and renewal

InSynk has a single plan: R79 (about US$5) per month, with unlimited goals and every feature included, plus a free 7-day trial for first-time subscribers only. South African members are billed in rand including VAT where applicable; members elsewhere are billed the equivalent in US dollars at the rate applying on the billing date. Subscription fees are InSynk’s own revenue and are separate from penalties, of which 90% goes to your chosen charity and 10% covers facilitation.

Unless you cancel before the trial ends, the trial converts automatically into a paid monthly subscription. Subscriptions renew automatically each month until cancelled. You authorise us and our payment provider to charge your chosen payment method on each renewal date and on the 1st of each month for any penalty due.

We may change prices on at least 30 days’ notice. Continuing after the notice period means you accept the new price; otherwise cancel before it takes effect.

7. Penalties and charity donations

At the end of each calendar month your success score is calculated as partner-approved logs divided by scheduled promises. A goal only counts from the day it was created — days before a goal existed are never scheduled or penalised.

Tiered penalties apply: R0 at 90% and above, rising in bands to R250 below 70%. Penalties are charged on the 1st of the following month. Of every rand collected, 90% is paid to the South African charity you selected and 10% is retained by InSynk as an administration and payment-processing fee.

Penalties are voluntary commitments you opt into by using the Service. They are not fines, damages or legally enforceable wagers. Tax-deductible donation receipts, where available, are issued by the receiving charity and not by InSynk. Charity payouts are made in batches; if a chosen charity becomes unable to receive funds, we will redirect your contribution to another registered South African public-benefit organisation and tell you which.

8. Cancellation and refunds

You may cancel your subscription at any time from your profile. Cancellation stops future renewals; access continues until the end of the paid period. Penalties already accrued for the current month remain payable. Our full Refund & Cancellation Policy sets out when money is returned, including your rights under the Consumer Protection Act and the Electronic Communications and Transactions Act.

9. Acceptable use

You agree not to: use the Service unlawfully or to harass, coerce or endanger anyone; set goals that promote self-harm, harm to others or illegal activity; attempt to access another person’s data; probe, scan or interfere with the Service or its security; scrape, reverse engineer, decompile or resell the Service; upload malicious code; or use the Service to run a competing product.

We may suspend or terminate accounts that breach this clause, with or without notice where the breach is serious.

10. Your content and our intellectual property

You keep ownership of the goals, notes and other content you create. You grant InSynk a non-exclusive, worldwide, royalty-free licence to host, store, process and display that content solely to operate and improve the Service and to make it visible to your paired partner. The InSynk name, logo, design, code and copy remain our property; nothing here grants you a licence to them beyond ordinary use of the app.

11. Third-party services and calendar export

The Service relies on third parties for hosting, authentication, email and payments. Goal calendar exports produce a standard .ics file that your device hands to your own calendar application; InSynk does not gain access to your calendar and is not responsible for how your calendar provider stores or displays that data.

12. Availability, changes and beta features

The Service is provided “as is” and “as available”. We do not warrant uninterrupted, error-free or timely operation, and we may modify, suspend or discontinue features. Scheduled maintenance, outages at our providers, or your own device or network problems may prevent logging on a given day; we are not liable for a score affected by such events, but will consider reasonable score corrections raised in writing within 14 days.

13. Limitation of liability

To the maximum extent permitted by South African law, InSynk and its officers, employees and suppliers are not liable for indirect, incidental, special, punitive or consequential loss, loss of profit, data, goodwill or opportunity, or for the acts or omissions of your accountability partner. Our total aggregate liability for any claim is limited to the subscription fees you actually paid to InSynk in the three months before the event giving rise to the claim.

Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability for fraud, gross negligence or death or personal injury caused by our negligence, or your rights under the Consumer Protection Act 68 of 2008.

14. Indemnity

You indemnify InSynk against claims, losses and reasonable legal costs arising from your breach of these Terms, your unlawful use of the Service, or a dispute between you and your accountability partner.

15. Suspension, termination and data deletion

You may delete your account at any time, which removes your profile, goals and logs subject to records we must retain for accounting and legal purposes. We may terminate these Terms on notice, or immediately for serious breach, non-payment or unlawful use. Clauses that by their nature should survive termination — including payment obligations, liability limits and indemnities — survive.

16. Disputes, governing law and severability

These Terms are governed by South African law, and the courts of South Africa have jurisdiction. Before litigating, both parties agree to attempt to resolve the dispute in good faith by contacting the support address in the app and allowing 30 days for a response. If any clause is found unenforceable, the rest remains in force.

17. Changes to these Terms and contact

We may update these Terms and will change the date above when we do. For material changes we will notify you in the app or by email before they take effect. Questions and formal notices go to the support address shown in the app.
